Schools often build a rich image library over the years — filled with moments that showcase the life, values and community spirit of the school. But what happens when a pupil featured in a lovely photo… no longer attends?
It’s a question I’m often asked when I’m working with schools on their marketing photography:
Can we still use that photo now the child’s moved on?
The short answer?
Yes – but only if the consent is still valid.
Here’s a breakdown of what that means:
1. Valid Consent is Key
Under UK GDPR, photos of children are considered personal data. This means any image you use must be supported by specific, informed consent.
If a parent or carer gave permission for the image to be used on your website or in promotional materials — and that permission is still valid — you’re likely within your rights to continue using it.
But there’s a catch…
2. Does the Consent Still Apply?
Not all consent lasts forever. Some schools use wording that clearly states images may be used for a set period or even after the child leaves. Others tie consent to the duration of the child’s time at the school — which means it may expire once they leave.
If the original form wasn’t clear on this, it’s safest to avoid using the image, or to seek renewed permission.
3. Best Practice: Stay Proactive
- Regularly review your image library
- Replace outdated content where possible
- Prioritise using images of current pupils with clear, up-to-date consent
- Keep a record of what each image is used for and whether consent covers it
4. As a Photographer, Here’s My Role
